Every three years, the US Library Of Congress carries out a review of the Digital Millennium Copyright Act (DMCA) and issues rulings on certain aspects of it.
In it’s most recent ruling, just handed down, it stated that the protection built in to the iPhone had little to do with copyright, and that therefore the act of bypassing that protection – jail breaking your phone – was considered to be fair use of your phone.
